Trademark Registration in India
A trademark is a unique symbol, word, logo, design, or combination of these that identifies and distinguishes a product or service from others in the market. Trademark registration in India provides legal protection and exclusive rights to the owner, preventing unauthorized usage by competitors.
Legal Protection – A registered trademark provides legal rights and prevents unauthorized use.
Exclusive Rights – The owner has the exclusive right to use the trademark for the goods/services it is registered under.

The process of trademark registration in India is governed by the Trademarks Act, 1999 and administered by the Controller General of Patents, Designs, and Trademarks under the Ministry of Commerce and Industry.
Before applying for registration, a trademark search is conducted to check if a similar or identical trademark already exists. This helps in avoiding legal disputes and application rejection.
The application can be filed online through the IP India website or manually at the respective Trademark Registry Office. The application must include:
Applicant’s details
Trademark logo or wordmark
Description of goods/services
Class under which the trademark is registered (based on NICE Classification)
Power of attorney (if filed through an agent or attorney)
After filing, the Registrar examines the application to ensure compliance with the Trademarks Act, 1999. If there are any objections, an Examination Report is issued, and the applicant is given a chance to respond.
If no objections are raised or successfully resolved, the trademark is published in the Trademark Journal for public opposition. If no opposition is filed within four months, the application proceeds further.
If no opposition arises, the trademark is registered, and a Registration Certificate is issued to the applicant. The registered trademark is valid for 10 years and can be renewed indefinitely.
